Add to that the stress of ensuring your tour company is reputable, that’s enough to make you stay home. That's where African Audacity Tours, LLC comes in - our name is our promise. We're bold, fearless, and offer unforgettable adventures that other tour companies might shy away from. Our goal is to deliver an incredible African experience at a price that won't break the bank, so you can focus on making memories, not worrying about your wallet.
Contract Terms and Conditions
By booking with us, you acknowledge that you've read and agree to the terms below, which include important details about liability, class action waivers, and venue selection that affect your legal rights. Confirming your booking means you're accepting these Terms and Conditions.
1. Introduction
These Terms and Conditions ("Terms") govern the relationship between you ("Client" or "you") and African Audacity Tours, LLC. ("Company" or "we" or "us"), a tour company operating in various countries across Africa. By booking a tour with us, you agree to be bound by these Terms.
2. Booking and Payment
2.1. To book a tour, you must provide accurate and complete information, including payment details.
2.2. A refundable deposit of $300.00 is required to secure your booking.
2.3. Payment methods include Zelle. (Coming soon bank transfer and credit card.)
2.4. All installment payments are non-refundable, unless specified otherwise in these Terms. Due to our contractual obligations with hotels, airlines, and other vendors, who don't allow refunds, we can't offer
refunds on payments. This arrangement enables us to maintain competitive package prices and offer convenient bi-monthly payment plans for your vacation.
2.5. African Audacity Tours, LLC. is not responsible for change fees, cancellation fees, or other extra costs charged by the airline from which you purchased your tickets.
3. Tour Itinerary and Changes
3.1. Please note that our tour schedules are flexible and may change due to unexpected events like weather, politics, or health issues. We'll strive to exceed your expectations by setting realistic promises and
delivering more.
3.2. We reserve the right to alter the itinerary, accommodation, or transportation arrangements if necessary, without prior notice.
3.3. In the event of significant changes, we will notify you as soon as reasonably possible.
4. Client Responsibilities
4.1. You are responsible for:
· Ensuring you have valid travel documents. See more details on Additional Information page.
· Complying with health and safety guidelines, including vaccinations and medications.
· Respecting local customs, laws, and regulations.
· Providing accurate and complete medical information.
5. Cancellation and Refund Policy
5.1. Client cancellations:
· 90 days or less prior to departure: 50% of total installment tour cost refundable.
· 60 days or less prior to departure: 25% of total installment tour cost refundable.
· 30 days or less prior to departure: 0% of total installment tour cost refundable.
5.2. Company cancellations:
· If we cancel a tour due to unforeseen circumstances, you will receive a full refund, or receive credit toward a future tour.
6. Liability and Insurance
6.1. We are not liable for:
· Any loss or damage resulting from your failure to comply with these Terms.
· Any unforeseen events beyond our control.
6.2. We recommend purchasing travel insurance to cover unexpected events, such as trip cancellations or medical emergencies.
6.3. Force Majeure - African Audacity Tours, LLC isn't responsible for unforeseen events like natural disasters, wars, or government actions that might affect travel. If such events happen, we won't refund your
money, though we will pass on any supplier refunds. We will keep the original deposit for planning time.
7. Health and Safety
7.1. You acknowledge that certain activities and travel in Africa may pose health and safety risks.
7.2. You are responsible for taking necessary precautions and following local health guidelines.
8. Conduct and Behavior
8.1. You must conduct yourself in a respectful and considerate manner towards other clients, staff, and local communities.
8.2. We reserve the right to remove you from the tour if your behavior is deemed unacceptable.
9. Data Protection
9.1. We will handle your personal data in accordance with applicable data protection laws.
9.2. By participating in this tour, I grant permission to African Audacity Tours, LLC to use, publish, and distribute any photos or videos taken during the trip in any medium without further notice or compensation. I
release African Audacity Tours, LLC and its representatives from any liability related to the use of such media.
10. Governing Law and Jurisdiction
10.1. This agreement is governed by laws of Delaware, United States of America, without regard to conflict or choice of law rules. Any disputes will be heard in a Delaware court. You'll bring
individual claims against African Audacity Tours, LLC not as part of a class action. We're only liable for compensatory damages; by paying a deposit, you waive your right to punitive damages. Before taking
any action, you'll provide a written notice of claim within 30 days of the tour or its cancellation.
10.2. Any disputes arising out of or in connection with these Terms will be resolved through arbitration.

12.3 Excess luggage on domestic and international flights.
12.4 Trip protection and insurance of all kinds.
12.5 Alcoholic beverages
12.6 Local shopping and activities not included on the detailed itinerary
12.7 Yellow fever shots
12.8 Malaria pills
13. Indemnification
13.1 Traveler agrees to and shall indemnify and hold harmless African Audacity Tours LLC, and its associated people (officers, agents, employees, etc.) from any losses, costs, or damages (including attorney fees)
that arise from:
1. Traveler's breach of this agreement.
2. Any damage caused by the traveler during the tour.
14. Entire Agreement
14.1. These Terms constitute the entire agreement between you and us.
14.2. We reserve the right to modify these Terms at any time. Upon making changes, we will notify you via the email address you provide to us at booking. The current Terms will apply to your booking.
